TEORÍA DE LAS NULIDADES

La nulidad se define como aquella sanción instituida en la ley consistente en la ineficacia de los actos realizados por votación. También podemos decir que es una situación de invalidez de los actos jurídicos que provoca que una norma, acto administrativo, o procesal dejen de existir sus efectos jurídicos para que una norma o acto dejen de existir se requiere de una declaración de nulidad.

ALGUNOS EJEMPLOS DE NULIDAD

* AUSENCIA DE CONOCIMIENTO EN UN ACTO JURÍDICO, COMO TOMAR EL TITULO DE UNA CASA SIN EL CONSENTIMIENTO DE SU DUEÑO.

*INCUMPLIMIENTO DE REQUISITOS LEGALES EJEMPLO VIOLAR LAS REGLAS DE UN CONTRATO.

*AUSENCIA DE ALGUNA CAUSA FINGIR ALGUNA SITUACIÓN INEXISTENTE.

*AUSENCIA DE CAPACIDAD PARA UN ACTO JURÍDICO, MENOR DE EDAD O ENFERMO.

*OBJETO ILÍCITO SIMPLEMENTE PROHIBIDO POR LA LEY.


ALGUNOS TIPOS DE NULIDADES

NULIDAD PARCIAL, AQUELLA QUE AFECTA SOLO UNA PARTE DEL ACTO POR EJEMPLO SEPARA LAS CLAUSULAS DE UN CONTRATO Y EL NEGOCIO NO  PIERDE SU ESENCIA.

NULIDAD ABSOLUTA ,ES CUALQUIER NORMA DE ORDEN PUBLICO QUE NO TIENE NINGÚN EFECTO JURÍDICO Y CUALQUIER JUEZ PUEDE DECLARARLA NULA .
